Mediation may be considered as a negotiation facilitated by a neutral third party who has expertise in the area of your dispute. In mediation, the decision to resolve the dispute is to be made by the disputing parties with assist of a trained mediator.
The mediator facilitates the resolution of the parties' disputes by supervising the exchange of information and the bargaining process. The mediator helps the parties find common ground and deal with unrealistic expectations. Solutions which the parties may not have considered may be offered. The role of the mediator is to interpret concerns, relay information between the parties, frame issues, and define the problems.
Mediation allows the parties to focus on the underlying circumstances that contributed to the dispute, rather than on legal issues. and does not focus on truth or fault but rather resolving the dispute at hand.
There may be many disputes involving healthcare topics. These may include quality of care, injuries, malpractice, right to benefits, insurance disputes, pharmacy disputes, and more. If a resolution is reached, mediation agreements may be oral or written, and content will vary.
